Terms of cover
Definitions
- Equipment shall mean ‘the handset/PDA (Personal
Digital Assistant) (Excluding all other components, camera attachments,
accessories and software downloads) having the IMEI (serial number)
and mobile
number jointly in use on and registered with Opal air time
and associated
accessories supplied with the relevant mobile phone excluding
PCMCIA cards.’
- Customer/You shall mean ‘the customer of Opal and
any person authorised by that customer to use the equipment.’
- Unattended shall mean ‘where the insured or authorised user
is not in a position to prevent the loss, theft or damage to the equipment’.
- Loss shall mean the sudden or unforeseen physical loss or
damage of the equipment.
Theft or robbery shall mean the dishonest appropriation
of equipment belonging to the customer if force or violence
are used or threatened,
with the intention of permanently depriving the customer
of that equipment.
- Period of cover shall commence from the receipt of written
instructions from you. This policy shall automatically
renew on a monthly
basis provided the insured pays the required premium unless cancelled
in accordance
with the terms below.
In consideration of continued payment of the monthly premium, Opal
will indemnify you against the cost of repair or replacement of your
mobile phone (to the same specification, which may be by way of refurbished
equipment), where such equipment has sustained sudden and unforeseen
physical damage or loss or theft during the period of cover, subject
to the following terms and conditions…
Number of claims
The company shall only be liable to pay two valid claims within any 12
month period and one claim in any calendar month on any mobile phone
number. Cover will only apply in respect of equipment that has been
provided by Opal for connection to that number on the Opal
mobile airtime account. This is tested by reference to the IMEI electronic
serial number that is registered with the mobile network at the time
of the claim.
Policy Territorial Limit
This policy shall only apply to the customers and their employees who
are permanently resident in the United Kingdom and whilst those customers
are temporarily travelling in any other country where the equipment
is usable up to a maximum of 30 days travel per year.
Excess
The company shall not be liable in respect of the first £25 of
any claim except where the claim is for replacement equipment which has
a
value up to £200 or the first £50 where
the claim is over £200.
Exclusions
The following are excluded:
- Claims as a result of theft or attempted theft of equipment from
any vehicle or premises left unattended unless evidence of forcible
and violent
entry to the vehicle is provided;
- Claims as a result of theft of equipment left unattended in a public
place or a place to which the public has regular access;
- Claims as a result of theft or attempted theft, loss or malicious/accidental
damage unless reported to the police and Opal within
24 hours of discovery;
- Any process of cleaning, servicing, maintenance, adjustment or repair;

Claims as a result of any loss where the equipment has been left behind
in an unknown location or it’s whereabouts forgotten
- Repairs to exterior paintwork caused by scratching or chipping of paintwork
or polished surfaces;
- Any cost or charges for which the manufacturer, supplier or distributor
are liable in accordance with their standard warranty obligations.
- Loss of use nor any consequential loss of nature whatsoever
- Any Loss
of damage caused by a wilful act or negligence of the customer, the
customer’s employees or any person using the equipment with
the customer’s permission.
- Loss or damage or consequential loss directly or indirectly occasioned
by war, invasion, act of foreign enemy hostilities (whether
war be declared or not), civil war, rebellion, revolution, insurrection or military
or
usurped power, nationalisation, confiscation, requisition,
seizure
or destruction by the government or any public authority.
- Loss or damage or consequential loss directly or indirectly occasioned
by ionising radiations or contamination by the radioactivity
from any nuclear waste from the combustion of nuclear fuel or the radioactive,
toxic, explosive or other hazardous properties of any explosive
nuclear assembly or nuclear component thereof.
- Loss or damage or consequential loss directly or indirectly occasioned
by pressure waves caused by aircraft or other aerial devices
travelling at sonic or supersonic speeds.
Limit of cover
The company may at its option repair or replace the equipment provided
with the same or similar equipment and subject to a maximum limit of £500
per authorised equipment claim.
The company will also reimburse the cost of unauthorised calls incurred
by the customer against the equipment number account as a direct result
of loss or theft, between the time of a loss or theft and the time the
equipment number account has been barred, subject to a limit of £500
per authorised calls claim and subject to the customer barring the equipment
number account with Opal within 24 hours of a theft or loss.
Reasonable precautions
The customer shall take all reasonable precautions to protect the equipment
and shall maintain the equipment in a proper state of repair.
Fraud
If you give misleading information when making a claim the policy will
be cancelled without notice by us and you will be liable to pay for
benefits already paid to you under this policy. No refund of premium
will be allowed and you may be prosecuted.
In the event of reporting a theft, Opal will blacklist the equipment
and bar the equipment number account to prevent unauthorised usage. This
will make the equipment unusable if found.
Claims – Procedure
Within 24 hours of the discovery of any incident that may give rise to
a claim under this policy the customer must notify Opal to bar
the equipment number from the account (in the event of loss or theft)
and inform the company to commence the claim procedure.
In the event of theft, loss or malicious damage, the customer must also
notify the Police and obtain a crime reference number or where available
a Police report.
Cancellation
The company or the customer may cancel this policy by giving 30 days
written notice to the other party.
Cooling off period
You also have a statutory right to a cooling-off period, which extends
for 14 days from the later of the day you are informed that the policy
has commenced and the day on which you receive the full terms and conditions
of your policy and in this event you will receive a refund of any premiums
already paid, unless we have already been notified of a claim.
